Through our partnership with a world-leading email marketing firm, strict policies and procedures are put into place to monitor and manage emails being sent through this service. Large import lists and emails going to a large number of contacts are actively being monitored.

Our email marketing service partner is a member in good standing of the Email Sender Provider Coalition (ESPC) and the Messaging Anti-Abuse Working Group (MAAWG), two organizations that fight the threat of spam while protecting the delivery of legitimate email.  Further, they invest resources into educating their users on email marketing and survey best practices.

Any customer using our email marketing service found to be distributing spam will have their account immediately terminated.  If you know of or suspect any violators, please notify us immediately at .

small circle How does OfficeSmarts protect you from sending spam?

We use a permission-based email-marketing tool that follows the strictest permission-based philosophies:

  • Communication - Your registration page already states why you are collecting the site visitor's email address, how you plan to use their address, and that you are following the embedded privacy policy.  Additionally, by accepting our license agreement you have agreed to use only permission-based lists and never to sell or rent your lists.
     
  • Verification – We automatically send all new contacts an email confirming their interest in receiving emails from you.  Additionally, if your contact changes his or her interests or unsubscribes, another email confirmation is automatically sent.
     
  • Unsubscribe - Every email generated from our email marketing service automatically contains a mandatory unsubscribe link, which allows contacts to opt-out of future emails and automatically updates your contact lists to avoid the chance of sending unwanted emails to visitors who have unsubscribed.
     
  • Identification - Your email header information is correct because it is pre-set for you by OfficeSmarts.  Your email's "From" address is verified and already accurately identifies you as the sender.
     
  • Contact Information - all of your emails are pre-set with your contact information including your physical address.

The recipient of your email has been clearly and fully notified of the collection and use of his or her email address and has consented prior to such collection and use. This is also called informed consent.  When submitting your email address to join a mailing list, you consent to the gathering and use of such information.

Spam is unsolicited email also known as UCE (Unsolicited Commercial Email). By sending email to only to those who have requested to receive it, you are following accepted permission-based email guidelines.

small circle Anti-Spam Laws

Canada’s new privacy law, the Personal Information Protection and Electronic Documents Act (PIPEDA), now requires that all companies engaging in e-commerce activities have a visible link to a Privacy Policy.  This will help to address concerns relating to on-line transactions, security of transactions, use of personal data from customers, etc.

The Canadian Coalition Against Unsolicited Commercial Email (Cauce Canada) played an active role in the spam task force and recently issued a letter to the Ministry of Industry bemoaning the lack of progress on anti-spam legislation.

The U.S. federal anti-spam law went into effect on January 1st, 2004 and preempts all state laws.  While this new law will not stop spam, it does make most spam illegal and ultimately less attractive to spammers.  The law is specific about requirements to send commercial email and empowers the U.S. federal government to enforce the law.  The penalties can include a fine and/or imprisonment for up to 5 years.
